Reservation terms
Terms applicable to main-range forklift reservations made through this website. Version of 27-10-2026.
1. Parties and scope
1.1. JP Solar Solutions, Lda., VAT number (NIF) 516651617, with a warehouse at Zona Industrial de Esmolfe, 3550-075 Penalva do Castelo («JP»), is the seller and receives the reservation request.
1.2. Reservations are intended for companies and sole traders buying for their business activity. By reserving, the customer declares that they are buying in that capacity.
1.3. The reservation applies to the main range (FE and V series, with lithium battery), with the configuration, equipment price and after-sales service agreed in writing before payment.
2. Nature of the reservation
2.1. The reservation deposit is €500 + VAT (€615 at 23%) in Portugal; €500 without VAT for businesses in other EU countries with a valid VAT number and outside the EU, deducted from the price, paid by bank transfer. The €615 paid is deducted from the purchase total including VAT.
2.2. The transfer constitutes a reservation request. The reservation is only accepted and binding when JP confirms receipt and acceptance in writing, within 3 working days of receiving the transfer. If it cannot accept, JP refunds all amounts received within 10 working days. The confirmation states the equipment, the price, the start date and the latest delivery date to the customer.
2.3. The form does not charge any amount. The transfer instructions and the request number are sent with the quote. The transfer alone does not start the delivery period: it starts on JP's written confirmation of receipt and acceptance.
Transfer: JP Solar Solutions, Lda. · Caixa Geral de Depósitos · IBAN PT50 0035 0009 0001 4369 8301 7 · BIC CGDIPTPL. Payment reference: reservation number.
2.4. JP invoices the reservation deposit as a forklift reservation. In the event of a refund, the applicable tax documents are issued.
2.5. In VAT-exempt sales, the deposit is €500 without VAT and the price is invoiced without VAT: a company in another EU country with a VAT number that is valid in VIES (intra-Community supply of goods, art. 14 RITI, Portugal, with reverse charge by the buyer) and export to Switzerland, the United Kingdom, Norway, Iceland or Liechtenstein (art. 14(1)(a) CIVA, Portugal). In these cases, references in these terms to amounts including VAT are to be read as the amounts without VAT. If VIES cannot be consulted when the request is made, the VAT number is confirmed before invoicing.
3. Refunds
3.1. After JP's written confirmation of receipt and acceptance, the reservation deposit is not refundable on simple withdrawal, without prejudice to legal rights.
3.2. If JP cannot confirm the order with the manufacturer, it refunds all amounts paid in full within 10 working days, at no cost and without the need for a request. The customer's right to double the deposit where the non-performance is attributable to JP remains in place, under Article 442 of the Portuguese Civil Code.
4. Balance after arrival at the JP warehouse
4.1. There is no interim payment after the reservation deposit. JP's written confirmation of receipt and acceptance holds the agreed configuration, price and terms.
4.2. After arrival and inspection at the JP warehouse, JP confirms the documentation, configuration and balance in writing. When the unit is ready to ship, it issues the balance invoice, due 15 days after issue.
4.3. The balance is the total agreed price including VAT, less the €615 already paid. No collection or dispatch without payment in full.
4.4. Arrival at the warehouse, issue of the invoice and the request for or payment of the balance do not restart or extend the delivery period to the customer.
4.5. If the balance is not paid on time, JP gives the customer written notice to pay within 8 days. If that period ends without payment, JP may terminate the contract by written notice and sell the unit to another customer; the customer loses the reservation deposit, which JP keeps as compensation, under Article 442 of the Portuguese Civil Code. This consequence does not apply where the non-payment results from a breach by JP or from the customer's legitimate exercise of a right.
5. Agreed price and transport
5.1. VAT is added at the applicable statutory rate. Collection from the warehouse in Esmolfe, or transport quoted separately by the carrier, at the customer’s expense. Unloading equipment or ramps suitable for the forklift are required at the destination.
5.2. The equipment price and terms are agreed in writing before the transfer. After JP's written confirmation of receipt and acceptance, the agreed terms prevail; transport remains separate.
5.3. Every option available in the configurator has a price. The configuration and the final equipment price are confirmed before the reservation deposit is paid.
5.4. A customer in another EU country without a VAT number that is valid in VIES is charged Portuguese VAT at 23%. If a number accepted while VIES was unavailable is not confirmed before invoicing, that rate applies and the VAT difference is added to the deposit and to the balance. For exports, customs clearance and import duties and taxes at the destination are borne by the customer.
6. Delivery period
6.1. Delivery to the customer is estimated at 14–16 weeks, with a limit of 20 weeks from JP's written confirmation of receipt and acceptance. Shipping, arrival at the warehouse and the request for or payment of the balance do not restart or extend this count. JP remains responsible for the delivery period to the customer.
6.2. If delivery exceeds 20 weeks, for reasons not attributable to the customer, the customer may cancel and JP refunds everything it received in full within 10 working days. The right to double the deposit where the non-performance is attributable to JP remains in place, without prejudice to other legal rights.
7. Warranty and returns
7.1. 12 months or 2,000 hours (the manufacturer's current terms, confirmed in each quote), without prejudice to the seller's legal liability. After-sales service terms in Portugal are agreed in writing before the reservation deposit is paid.
7.2. Sales to businesses and sole traders (clause 1.2) are not returnable: once the reservation is accepted, the equipment cannot be returned or exchanged because the customer withdraws or changes their mind. This rule does not exclude the warranty in clause 7.1 or the seller's liability for lack of conformity or defects.
7.3. The rule in clause 7.2 does not apply to consumers. If JP sells to a consumer, all the rights the law gives them remain, including the legal guarantee of goods (Decree-Law 84/2021) and, in distance contracts, the right of withdrawal (Decree-Law 24/2014), on the terms and with the exceptions set out there.
7.4. Customers outside Portugal have the same warranty of 12 months or 2,000 hours. Service is carried out at our warehouse in Esmolfe, Penalva do Castelo: the customer brings or ships the equipment, and transport is at their expense. Parts can be sent by carrier and diagnosis can be done remotely, by video.
8. Personal data and disputes
8.1. Data is processed in accordance with the privacy policy.
8.2. Portuguese law applies.
